Children's Privacy Notice

Moxie Robots, Inc. ("Moxie") understands privacy is important for our users and we take certain precautions to protect the privacy of our youngest users. This Children's Privacy Notice applies when Moxie collects personal information from children under 13 ("Child Users") through the Moxie website (the "Site"), the Moxie mobile application (the "App") and the Moxie robot (the "Robot") as well as the related content, products, services, or other functionality offered on or through the Sites, Robot, App, and any other website or mobile application that we own or control and which posts or links to this Children's Privacy Notice (all collectively, the "Service"). All defined terms in this Children's Privacy Notice shall have the same meaning as defined in the Privacy Notice.

Moxie does not knowingly collect personal information from children under the age of 13 without the consent and at the direction of a parent or legal guardian. Moxie permits parents to set up profiles associated with parent accounts via the Service, so that children may access the Service (including by interacting with the Robot) under the supervision of a parent or legal guardian. We endeavor to only collect as much information as is reasonably necessary for the child to use the Service and to ensure that parents or legal guardians have access to and control of their child's use of the Service. This Children's Privacy Notice applies to all Child Users of the Service. To learn more about our general privacy practices that apply to parents and our other users, please refer to the Privacy Notice and our Consumer Health Data Privacy Notice.

If we learn that personal information of a child has been collected on our Service without appropriate parental consent, then we will take appropriate steps to delete this information. If you are a parent or legal guardian and discover that your child under the age of 13 has a registered account with our Service without your consent, please contact us at hi@moxierobots.com and request that we delete that child's personal information from our systems.

How to create a Robot profile associated with an account

For all known Child Users, a parent must set up an account using a valid credit/debit card and must agree to the terms of our Terms of Service, Privacy Notice, Consumer Health Data Privacy Notice and this Children's Privacy Notice. By creating or validating a profile associated with a Robot and permitting your child to use the Service, you expressly agree to the practices described in this Children's Privacy Notice and you consent to the collection, use, and disclosure of your child's personal information as described herein. You can withdraw consent at any time by contacting us at hi@moxierobots.com and request that we delete that child's personal information from our systems.

What information does Moxie collect from or about a Child User?

We collect personal information from Child Users in the following ways through their use of the Service:

Information you provide us. When setting up a Moxie account, the parent or legal guardian may provide information about the Child User authorized by the Parent to use the Service, including the Child User's name, email address and date of birth. Moxie uses this information to provide the Service to the Child User and to communicate to the app users about the Child User's account, such as account notifications and password resets, via email.

Your Child's Account Information During and After Parental Consent. During the parent validation process, we may collect from parents or legal guardians the following information: parent or legal guardian role (mother, father, other), first and last name, phone number and email address. After such validation has been successfully completed, we may also collect any additional information from or about your child that they or their parent or legal guardian may provide, such as name and interests. We use this information to provide the Service to your child, to provide parents or legal guardians with appropriate controls for your child's use of the Service, to communicate with parents or legal guardians about their child's account and activities and for other purposes as described below.

Information Collected Through Use of the Service. As part of the Service, we collect the following types of information about your child's use of the Service:

Faceprint and Image Data, including facial expression datapoints (created to identify the user's expression), primary user image datapoints (used to identify the primary user) and similar data which may be created based on analysis of the user's video data. Some of this data may be considered biometric data under certain privacy laws. We use this content primarily to provide you with our products and services.

Audio Data, including raw audio data collected through the Robot, audio transcript data, voice activity signals to allow the Robot to wake up upon command (if you have enabled this feature) and other similar data. Some of this data may be considered biometric data under certain privacy laws. We use this content primarily to provide you with our products and services, to facilitate your requests, and to improve our products and services.

Video Data, including raw video data collected through the Robot. We use this content primarily to provide you with our products and services, to facilitate your requests, and to improve our products and services.

Health Data, which may include summary information about the child's activities (e.g., books read, vocabulary level, time spent reading, badges or trophies, etc.), data associated with the child's interactions with Moxie (e.g., audio transcript data, facial expression datapoints and responses communicated to Moxie), and data derived from data input by the user, such as, how the child is doing in achieving missions and goals and progress towards achieving those goals (e.g., improvements in language skills, how long the child was engaged with the robot, number of words read per minute). We use this content primarily to provide you with our products and services.

Geolocation Data, when you use our Service, we may collect geolocation data such as latitude and longitude via the Robot and data associated with the child's interactions with Moxie (e.g., whether/ where other objects or persons may be located in a room). We collect this type of data if you grant us access to your location through the app. You can remove our access at any time through your mobile device settings or exercising the controls described in the Privacy Notice. We may also derive your approximate location from your IP address. We use this content primarily to provide you with our products and services.

Device Usage Information. We automatically collect usage information as well as information about the Moxie robot, mobile device and network used to access the Service. For example, we may collect an IP address or a partial IP address, location when shared, language preferences, VOIP token, device name, OS Version, screen resolution, time zone, device local, build model and build manufacturer, device messaging availability, available camera, device authentication token, random install ID, IP address, crash report and other information about the device used to access the Service, such as the device type, model and manufacturer. We also collect usage information such as the day/time stamp, pages viewed, and similar information. This information may be typically collected through cookies or mobile SDKS or similar technologies. We use this information to operate, maintain and provide the features and functionality of the Service, and to develop and improve our Service.

Additional Information from Parent or Legal Guardian. We may collect the following information from parents or legal guardians: second parent or legal guardian first and last name, phone number and e-mail address. We use this information to provide the Service to the Child User, to provide parents or legal guardians with appropriate controls for their Child User's use of the Service, to communicate with parents or legal guardians about their child's account and activities, and for other purposes as described below.

How does Moxie use this information?

We use the information we collect for the following purposes and as otherwise described above:

To provide the Service and its services and enable Child Users, parents or legal guardians, and other Service users to communicate with the Robot and to us through the App.

To personalize the experience, including by providing personalized responses based on audio and video data.

To improve our Service and for other internal business purposes, such as evaluating and enhancing the Service, improving the Service and troubleshooting.

To communicate with parents or legal guardians, and Child Users, such as when we receive a contact inquiry, provide updates on Child User activities and send information about our policies, terms, and practices.

To help maintain the safety, security, and integrity of the Service, technology assets, and our users.

We may use human review, automated systems and/or machine learning to accomplish the functions and activities listed in this section.

How does Moxie share this information?

We may share a Child User's personal information in the instances described below. For additional information on your choices regarding personal information, see "How to access, manage and delete a Child User's personal information" hi@moxierobots.com below.

We may share or disclose a Child User's personal information to third-parties in the following instances:

With your child's parents or legal guardians. We share your child's information and activities (such as interactions with Moxie and profile information) with the parent account associated with your child.

With our AI service providers. We may share your child's information with our third-party service providers, such as Google, Anthropic and OpenAI to provide our services. For example, this may include service providers who assist us in providing the AI-powered tools that form a part of our Service. Our current list of service providers is available upon request. As required by applicable data protection laws, we impose contractual limits on how these service providers can use the personal data they receive.

With other third-party service providers. third party vendors, service providers, contractors or agents who perform services and functions to us on our behalf and who are subject to confidentiality and security obligations.

We may also share their personal information if we have a good faith belief that access to or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process, judicial proceeding, or enforceable governmental request; (b) enforce applicable Terms of Use, including investigation of potential violations thereof; (c) detect, prevent or otherwise address fraud, security or technical issues; (d) protect the rights, property, or personal safety of Moxie, its users, or the public; or (e) as required or permitted by law. If Moxie is involved in a merger, acquisition, bankruptcy, change of control, or any form of sale of some or all of its assets. In this case, personal information may be transferred or disclosed in connection with the business transaction, subject to any applicable laws. We may also use and share de-identified or aggregated information in a manner that cannot be reasonably used to identify an individual user.

Third Party Tracking, Advertising and Analytics. We do not permit third parties to collect personal information from or about our Child Users over time for the purpose of serving targeted advertising on our Service or on other websites, services or mobile applications that are directed to children and families. We do work with some third-party partners to collect data (typically through cookies, mobile SDKs or similar technology) through our Service for purposes of providing analytics, fraud detection, A/B testing, and some advertising services, but we take certain steps designed to limit the amount of data they can collect from Child Users.

How to access, manage, and delete a Child User's personal information

Withdrawing Your Consent

Where we have your consent for the processing of your personal data (e.g., when you opt in to safely share analytics with us), you may withdraw your consent by submitting a request in the Privacy Settings of the mobile application or by contacting us as set forth in the Contact Us section below.

For Child Users: At any time, parents or legal guardians may revoke their consent provided, refuse to allow us to further collect or use your child's personal information, and direct us to delete your child's personal information by contacting us at hi@moxierobots.com. You may also cancel your child's account at any time by accessing your parent section within the Service.

Request Access to Your Personal Data

You may request a copy of the personal data we have collected and maintained about you by submitting a request in the Privacy Settings of the mobile application or by contacting us as set forth in the Contact Us section below.

For Child Users: Parents or legal guardians may review the information collected from their Child User(s) at any time by logging into the parent section of the Service or contacting us at hi@moxierobots.com to fulfill this request.

Modifying or Deleting Your Personal Data

If you have any questions about reviewing, modifying, or deleting your personal data, you may submit a request to modify or delete your personal data by submitting a request in the Privacy Settings of the mobile application or by contacting us as set forth in the Contact Us section below. We may not be able to modify or delete your personal data in all circumstances. You may also cancel your child's account at any time by accessing your parent section within the mobile application.

For Child Users: Moxie will retain the personal information collected from and about the Child User for as long as necessary to provide the Service and will de-identify or delete the personal information after the termination of the account in accordance with our standard data-retention policy or until we receive a deletion request. To request deletion of personal information of a Child User at any time, please contact us at hi@moxierobots.com.

Updates and Changes to this Notice

Before we make material changes to our data collection, use, or sharing practices as reflected in this Children's Privacy Notice, we will notify parents or legal guardians so they have the opportunity to review the changes before they go into effect for the Child User.
